// ]]>Paramedics immediately rushed the woman to Mercy Hospital where her condition is still unknown. The exact cause of this boat accident is not clear. Investigating officers need to get answers to many questions. Was there a mechanical fault in the boat that caused the woman to fall overboard? Was the boat driver intoxicated or under the influence of drugs or alcohol? How did this woman go missing for at least 15 minutes and why did her friends not know where she was? Was the woman wearing a flotation device and, if not, why not?

Our office offers our sincere sympathies to the injured woman and hope that she fully recovers. Hopefully she has not suffered any brain injury due to lack of oxygen. The woman may very well wish to consult with an aggressive boating accident lawyer who can advise her of her rights and discuss her case with her.

The body of a fourth man involved in a Marin County boating accident was recovered on July 16, 2010. According to Flight Technical Officer, the Sonoma County Sherriff’s helicopter received a call around 2:01 p.m. that a body was found near 10 Mile Beach close to Point Reyes. A 3-person recovery team passed the recovered body to the rangers where the Point Reyes National Seashore took the custody.

The bodies of the Ronald Fuentes, 65, Melvin Cox, 67 and Henry Medrano, 62 were pulled by the coastguards on July 14, 2010. It is believed that the body recovered on July 21, 2010 is of Jack Taylor, 62 who was the boat owner.

All four victims were lifelong friends and would come to Bodega Bay for fishing and camping each year.

This is indeed a tragic accident and the authorities are taking immediate action to know what caused the boat to capsize. Our prayers go out to the friends and families of the deceased. We hope that the investigation brings answers and peace of mind.

Matthew P. Fortin of Rhode Island has been charged with drunken driving of a boat when his speeding boat caused the death of two women. It appears that, under the influence of alcohol, Fortin was negligent and hit another boat that was carrying these two women. He has been charged with five felony counts related to the boating accident. However, no criminal charge or monetary compensation could ever make up for the harm caused by Fortin’s carelessness.

Fortin has not entered any plea yet and has been released after posting cash bail of $1,000. He will return to court soon.

If this boat accident happened in California and our office advised the families of the deceased, we would advise them that they may be entitled for compensation to cover the cost of funeral, loss of life, loss of earnings and other related damages. In addition, if Fortin is convicted of felony driving under the influence, their families may be entitled to have their attorneys’ fees paid by Fortin. Normally, personal injury victims must bear the expense of paying for their attorneys and litigation costs.

Abby Sunderland, a 16-year old teenager from California, was rescued on June 19, 2010 from her broken boat drifting in the middle of the Indian Ocean. Despite her familiarity with the water and sailing, high winds and rough water damaged the mast of her vessel leaving her boat adrift in the ocean. Her radio transmitter was also damaged, making it difficult for her request help.

This boat accident led to a huge amount of public outcry against Abby’s parents, especially the father who allowed her to undertake such a big risk. In the end, though, only Abby’s sailing abilities saved her life. Her father and the training he helped her obtain prior to the trip were responsible for keeping her alive. Nevertheless, parents should always make sure that their children have adequate knowledge of their vessel, sailing, and that they have a prepared game plan for the worst case scenario that can happen.

We wish and hope that Abby recovers from her injuries completely. We also hope that she is able, with the proper safety and training and precautions, be able to complete her voyage and achieve her goal to sail around the world.

Two children sustained injuries in Destin, Florida, when a parasail line broke and the children in the parasail fell away to the water below. At the time when this boating accident occurred, the parasail boat was being pulled in due to unfriendly weather conditions.

The children were transported immediately to a local hospital in Pensacola where they were treated for their injuries.

Water sports are quite popular these days, but it is the parents and water sport business owners that have to see determine whether the weather is conducive to outdoor activities. Investigators have already given much criticism to the parents for allowing the children to be in the parasail with bad weather approaching. Dangers are always involved in water sports and, ultimately, it is the business owner who has to decide the safety restrictions to keep their patrons safe. Recreational businesses carry a huge responsibility to their customers as a negligent act can prove fatal.

A 33 year-old man, Matthew Bankes was injured in a boat accident on June 5, 2010 at 5:15 p.m along the Mississippi river south of Brownsville, Minnesota. According to the press release made by the Houston County Sherriff’s Officel, Bankes fell out of the boat that he was riding and was then struck by it.

It is believed that the propeller of the boat and boat itself hit Bankes badly, leaving him with serious brain and back injuries. Information about Bankes present condition is not available.

We offer our deepest sympathies to Bankes and his family for such tough time and wish for his speedy recovery. However, one has to wonder why Bankes fell out of the boat and was then struck by it. Did it hit a wake unexpectedly, sending him overboard? Was he drinking or intoxicated? Did he simply lose his balance? It is impossible to tell from the facts of the supporting news story whether the negligence of someone else caused his injuries.

A man, between 60 to 65 years old, was killed in Millerton Lake on May 26, 2010 when his boat crashed into a rocky shoreline on the Madera side of the lake. This boating accident occurred at Gold Bay at around 1:45 p.m. A resident of the Hidden Lake Estates called 911 and reported an unconscious man bleeding profusely by his wrecked boat.

Lifeguards present at the lake performed CPR on the injured person, but he did not respond. The injured man was airlifted to Fresno’s Community Medical Center, where he was declared dead.

The investigation is still underway to know if the victim was under influence or if it was a mechanical failure. If this accident occurred due to a mechanical failure, then the victim’s family might be entitled for compensation. The family of the victim should get in touch with an experienced lawyer who can hire personal detectives to find the cause of the accident. The findings may be in favor of the family and allow them the ability to at least right the scales of justice.

Luke Nelson, 5-years old, of Riverside County died in a boating accident on May 23, 2010, around 2:41p.m. in Lake Elsinore close to Crane Lakeside Recreational Vehicle Park when the watercraft he was riding in was overturned due to windy waters.

According to the Riverside County Coroner’s Office, Luke Nelson was wearing a life jacket when the accident happened. However, onlookers who rushed to aide the overturned vessel were questioning whether he in fact was wearing a life preserver. The other two boaters, Ken Nelson and Ricky Gillmaster, also flipped over due to unknown reasons and have sustained injuries.

Witnesses said that the boat had been crossing the lake in the high speed zone and was coming back when the vessel hit a wake and overturned. In a telephone interview, the boy’s aunt, Jodie Drysol, reported that the boat was travelling at a safe rate of speed and that neither Ken Nelson or Ricky Gillmaster had been drinking.

We offer our deepest condolences to Luke Nelson’s family for this devastating loss and hope that the injured will recover completely soon. Little Luke was formerly known as Lucas Garrison, but was about to be adopted by Ken Nelson and had changed his name.

Alcohol is one of the factors which can lead to accidents—not just on the road but also while boating and enjoying the water. A 28-year old woman was seriously injured in a jet ski accident that took place on April 3, 2010 at Destin, Florida, which involved the use of alcohol.

Reportedly, the woman had been drinking before she met up with the accident that caused her to lose consciousness for 20 seconds. She was riding the jet-ski with a man on the back as a passenger when she jumped a wave and landed wrong. The man was ejected and her head hit the handlebar in front of her. She was found floating face down and had a three-inch laceration near her left eye.

Our office wishes her a quick recovery. Although alcohol was not the cause of this accident, it was a factor. This jet-ski accident could have taken a nastier turn had she not been saved and pulled out of the water before she drowned. Please be responsible when you boat and enjoy your time on the water responsibly.

Two men lost their lives in a boat accident that took place on April 10, 2010 on the Allegheny River near Harmar, Pennsylvania.

The deceased, 59-year-old North Huntingdon resident Gary Watson and 26-year old California resident Brian Abercrombie, along with Watson’s son, Cale Watson, were fishing beneath the dam at lock 3 in Harmar when their 16-foot boat struck the dam and capsized. All three went down into the water. Cale was the sole survivor as he swam to the shore, but the others drowned. None of the boat passengers were wearing a life vest or a floatation device.

Our office wishes to offer our sincere condolences and heartfelt prayers to the friends and families of the deceased. Although the investigation has not been concluded, the lesson that can be taken away from this is to make sure that all passengers on your vessel wear flotation devices at all times. It is impossible to tell when an accident is about to occur. Therefore, one cannot plan to put on a flotation device when a situation gets dangerous. One must assume that danger can arise at any moment.
